Onshore protection

The onshore component of the Refugee and Humanitarian program aims to provide options for people who are in Australia and wish to apply for protection (or asylum). There is one visa available for people onshore who wish to apply for protection.

Protection Visa (Class XA) (Subclass 866)

This visa allows you to live and work in Australia as a permanent resident, having access to Medicare and Centrelink services and also receive a range of services to assist them in settling into life in Australia.

To be granted a Protection Visa you will need to:

  • be found to be owed protection in Australia, because you are a refugee as defined by the Refugees
    Convention, or because you meet the complementary protection criteria
  • be currently in Australia
  • pass character and security checks
  • undergo the required health examinations, and
  • sign the Australian Values Statement.

Who is owed protection in Australia?

People who are outside their country and are unable or unwilling to return because they have a well-founded fear of persecution because of their:

  • race
  • religion
  • political opinion
  • nationality, or
  • membership of a particular social group.

People are owed protection in Australia under complementary protection obligations if there is a real risk that if they return to their home country they will suffer any of the following types of “significant harm”:

  • arbitrary deprivation of life
  • death penalty
  • torture
  • nationality, or
  • cruel or inhuman treatment or punishment
  • degrading treatment or punishment.
