Subclass 309 / 100 partner visa

Spouse Visa (Onshore) – Temporary & Permanent – Subclass 309 & 100

A 2 stage Permanent Application process that allows you to enter and remain in Australia on the basis of your spousal relationship with your de-facto or legally married partner who is an Australian citizen, an eligible New Zealand citizen or permanent resident.

You must be married to your partner, have been in a de-facto relationship with your partner for at least 12 months up to the day you lodge your application, your relationship must be genuine and ongoing and your partner must be approved to sponsor you before you come to Australia. In some circumstances you can lodge the application if you have been in a relationship for less than 12 months.

Initially you will be granted a 2-year temporary visa, then, if your relationship is still ongoing and you are otherwise eligible, you will be granted a permanent visa.

With this visa you can work and your dependent children and dependent family can accompany you to Australia and get permission to study and work in Australia.
