Employer nomination scheme subclass 186 (Permanent)

The subclass 186 permanent visa allows an Australian Employer to nominate a foreign worker who is either inside or outside Australia for permanent residence.

There are three methods (schemes) by which these visas are obtained:

  • The Temporary Residence Transition Scheme;
  • The Direct Entry Scheme; and
  • The Labour Agreement Scheme.

The Temporary Residence Transition

This stream is for workers on subclass 457 visas who have been employed in an Australian business for 2 years.

The requirements are:

  • Less than 50 years old;
  • Adequate English;
  • The nominated position needs to be the same position as the subclass 457 which continues to be
    available for the Applicant;
  • The Applicant must receive the Market Rate of salary;
  • The Employer must continue to meet the training requirements of the subclass 457 visa.

The Direct Entry Scheme

This stream is for foreign workers not on 457 visas or not on them for 2 years.

The requirements are:

  • The business is actively operating in Australia.
  • Full-time position that is available for at least two years.
  • A skilled occupation.
  • The business must be training its Australian staff or paying into a registered training fund.
  • Adequate English.
  • Skills assessed by Australian authorities.
  • 3 years’ relevant experience.

The Labour Agreement Scheme

This stream allows for Australian companies to individually negotiate with the Australian Government for the orderly entry of large numbers of skilled workers into Australia.
