General Litigation &
Contractual Disputes

Are you in a contractual dispute?

Knowing where you stand in a dispute concerning the provision of good and services between individuals and companies can be difficult. Not only is there usually a contract between the parties which needs to be interpreted and understood, but there are several pieces of legislation that govern these contracts, such as the Australian Consumer Law and the Contracts Review Act. Getting professional advice at the right time can make all the difference.

Have you been served with a court document?

If you are served with any court document regarding a civil dispute you usually have 28 days to file a defence. If you do not file a defence, default judgment can be entered in your absence. Ultimately, this could lead to your wages being garnished, having your personal property sold or ultimately you being declared bankrupt.

Manning Lawyers can assist

Brendan Manning has a Masters in Commercial Law and together with Andrew Manning, can provide you with professional advice to help you resolve your commercial disputes through settling the matter, appearing in Court and when necessary, assembling a multidisciplinary team of barristers, accountants and other experts. In some case, smaller commercial disputes can be dealt with through the New South Wales Civil & Administrative Tribunal or NCAT. This is a cost-effective way of having your dispute resolved without legal costs being payable by you if you are not successful in proving your case. However, larger contractual disputes or claims of damages are usually heard in the Local, District or Supreme Court and will require specialist legal advice.
