Refugee Visas

A person may be eligible for the grant of an Australia visa on the basis they are recognised as a refugee or that, although they are not considered a refugee, they are in need of protection by Australia. There are different programmes in operation and dependent on whether the applicant is in Australia or outside of Australia however, as at 24 March 2012, the same process for assessment of protection claims will apply to applicants in Australia regardless of whether they came by air or by boat (irregular maritime arrival). Eligibility of the grant of a protection visa is based on many factors, including but not limited to the degree of persecution or discrimination to which the applicant is subject in their home country, whether or not the applicant has a right to reside in any country other than Australia and they have been identified as a refugee or a person subject to persecution or substantial discrimination amounting to gross violation of human rights in their home country and deemed to be in humanitarian need.
